These Terms of Service ("Terms") are an agreement between you and KidCheck ("KidCheck", "we", "us", or "our") and govern your use of the KidCheck mobile application and related services (the "Service"). Please read them carefully. By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for parents and guardians making decisions for the children in their care. By using the Service you confirm that you meet these requirements.
KidCheck lets you scan a movie, show, game, book, app, or similar item and receive an automatically generated verdict about whether it may be a good fit for a child, based on the age and preferences you provide. The Service may also show community trends and suggest alternatives.
This is important. KidCheck verdicts are generated by automated systems and are provided for general informational purposes only. They are not professional, legal, medical, psychological, or educational advice, and they are not a guarantee about the content, safety, or suitability of any item.
Content, ratings, and availability change over time, and automated systems can be wrong or incomplete. You are responsible for your own decisions about what is appropriate for your child. Always use your own judgment and review content yourself before allowing your child to access it. Do not rely on KidCheck as the sole basis for any decision about your child's safety or wellbeing.
The Service offers optional paid subscriptions that unlock additional features and higher usage limits.
You agree not to:
You keep ownership of the images and information you submit. You grant us a limited license to use that content only to operate and provide the Service to you, including sending it to our AI provider to generate a verdict. You are responsible for the content you submit and confirm you have the right to submit it.
The Service, including its software, design, text, and branding, is owned by KidCheck or its licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms.
The Service relies on third parties, including Apple, our payments partner, our AI provider, and public ratings sources. Your use of those services may be subject to their own terms. We are not responsible for third-party services, links, or content.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or that any verdict will be accurate or complete.
To the fullest extent permitted by law, KidCheck and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on a verdict or your use of, or inability to use, the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or 25 US dollars.
You agree to indemnify and hold harmless KidCheck from any claims, damages, and expenses arising out of your misuse of the Service or your violation of these Terms.
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Service after an update means you accept the revised Terms.
You may stop using the Service at any time. We may suspend or end your access to the Service if you violate these Terms or if we discontinue the Service.
These Terms are governed by the laws of the jurisdiction in which KidCheck operates, without regard to conflict of law rules. Nothing in these Terms limits any rights you may have that cannot be waived under the law that applies to you.
